Kevin Harvick’s team is no longer locked into the Championship round following a major penalty assessed by NASCAR today.

The #4 team’s winning car from Texas Motor Speedway violated Section 20.4.12 of the NASCAR Rule Book that is specific to spoilers. Spoilers must be used exactly as supplied from the manufacturer and not altered. As a result Harvick has been docked 40 driver and owner points and the teams win at Texas no longer locks them into the Championship 4. Harvick is now 4th in points, Just 3 points above the cutline.

In addition, crew chief Rodney Childress and car chief Robert Smith are both suspended for next weeks race at ISM Raceway and Childress is facing a $75,000 fine.

The team has the option to appeal the penalty, which will more then likely be expedited if they chose to do so.
